“Legal Issues Arising from an Associate Dentist Leaving your Practice”: What are the rights of the Principal, and the Associate, and how should records transfer requests be processed?
My presentation will address the legal issues arising when an Associate leaves a Principal dentist’s practice.
  1. Can an Associate dentist contact patients of the practice to notify them of his or her departure?
  2. Can a Principal dentist prevent patients being notified?
  3. If a notification is provided, what should go in the notice?
  4. Can an Associate dentist gather patient contact information in order to carry out this notification?
  5. What are the respective obligations of the Principal and the Associate dentist concerning records requests from patients, if they choose to follow the Associate to a new practice?
All of these issues will be addressed in light of the 2025, Ontario Court of Appeal decision in Coscarella v. Harvey, which concerned a dispute between a Principal dentist and an Associate dentist about these issues.
